TERMS AND CONDITIONS OF SERVICE
A-Frame Photo & Aerial
Ice Cream Entertainment LLC, DBA A-Frame Photo & Aerial
1. Definitions
- "A-Frame" refers to Ice Cream Entertainment LLC, doing business as A-Frame Photo & Aerial, the service provider.
- "Client" refers to the agent, business, or individual purchasing Services.
- "Services" refers to photography, videography, drone photography, 3D tours, and related services.
- "Materials" refers to all deliverables, including photos, videos, 3D tours, floorplans, and other content.
2. Photography Services
2.1 Shooting Conditions
- Properties will be photographed as-is, in their existing condition at the time of the appointment. A-Frame is not responsible for property preparation, cleaning, staging, or decluttering.
- If additional photos are requested beyond the purchased package, the Client is responsible for the cost of the corresponding larger package.
2.2 Property Access
- The Client is responsible for ensuring the photographer has access to the property via garage code, keypad, hidden key, or by having the agent or homeowner present. A-Frame photographers cannot access realtor lockboxes.
- If access is not provided and the appointment has not been cancelled or rescheduled, the photographer will wait 15 minutes past the scheduled start time, capture the standard exterior photos only, and the Client will be responsible for additional fees for a return visit.
2.3 Travel Fees
- Properties located more than 25 miles from the Meridian, Idaho town center incur an out-of-town travel fee as listed on the A-Frame website.
- If the appropriate travel fee is not added at booking, the Client authorizes A-Frame to charge the missing fee to the card on file.
2.4 Reshoots and Modifications
- Reshoots are provided at no cost only for technical errors on the part of the photographer, such as blurry shots or missed rooms (not missed angles).
- Reshoots are not available for subjective or artistic differences, including but not limited to composition, angles, framing, or lighting preferences.
- Additional Photoshop work - including lawn greening, object or clutter removal, blurring of license plates or family photos, and the wet driveway effect - is not included in standard packages and may be purchased separately.
- The wet driveway effect applies to ground photos only. Drone photos are shot from angles that make realistic reflections infeasible.
- Twilight photo return-visit fee: $100.
3. Intellectual Property and Licensing
3.1 Ownership
- A-Frame retains all ownership rights, including copyright, in all Materials produced. Purchase of Services grants the Client a limited license only; it is not a transfer of ownership.
3.2 License Terms
- Materials may be used solely for marketing the specific property, business, or individual(s) represented in the Materials.
- Materials may not be rebranded, resold, transferred, or used for any other purpose without the express written consent of A-Frame. If another agent acquires a listing, Materials may not be resold or transferred to that agent except as provided in Section 9.
- License duration: photos, 3D tours, and floorplans are licensed for 12 months from the date of purchase; property videos are licensed for 24 months from the date of purchase; Video Business Cards and business promos are licensed to the Client indefinitely.
- Download links and marketing kit access expire 12 months from the order date.
- The Client may add their own branding to delivered videos. A-Frame is not liable for any Client-added content that infringes the intellectual property rights of others.
3.3 Portfolio and Promotional Use
- The Client grants A-Frame the irrevocable right to use any Materials created during the session for portfolio, promotional, and marketing purposes, including but not limited to A-Frame's website, social media, advertising, and public showcases.
- This may include publishing Materials before the listing goes live on the MLS, provided the content does not state that the property is for sale or identify the listing agent or price.
- If the Client or listing agent wishes to delay or restrict public sharing, that request must be submitted in writing prior to the shoot. Otherwise, Materials may be shared at A-Frame's discretion.
4. Drone Services
4.1 Standard Deliverables
- Standard drone angles include: roof-level front, roof-level back, eagle eye, and four corners.
- One property outline (color pop) is available upon request for an added fee. The Client must provide a plat map or a clear, easy-to-follow property outline for the editor's reference.
- Any property lines or boundaries depicted in drone imagery are approximate and for illustrative purposes only. They do not constitute a legal survey and must not be relied upon to determine property boundaries or land ownership. Clients should consult a licensed surveyor for precise boundary information.
- All property outline edits will include the disclaimer "Approximate property lines - not a legal survey." The Client agrees not to crop or remove this disclaimer from the image.
4.2 Weather Conditions
- Drone operations are subject to weather conditions. If drone shots cannot be captured during the scheduled shoot, the Client may elect to have the drone fee refunded or pay an additional $50 travel fee for a return visit.
5. 3D Tours (Zillow and Matterport)
5.1 Technical Specifications
- 3D tours are optimized for mobile viewing and cannot be edited after capture.
- Coverage focuses on the main dwelling, with a maximum of 2 exterior captures and 1 capture per main room. Matterport tours focus exclusively on interiors.
- 3D cameras use ambient light, which may result in mixed color temperatures or color casts.
5.2 Third-Party Services
- Zillow and Matterport perform rendering and delivery on their own platforms; delivery timeframes are outside A-Frame's control. Zillow floorplan delivery is generally 1 business day but cannot be guaranteed.
- Floorplans are generated by third-party providers and cannot be modified by A-Frame, including dimensions and room names. Any floorplan issues must be addressed directly with Zillow customer service.
- Floorplans are not included by default and may be included at the photographer's discretion upon request.
6. Video Production
6.1 Deliverables
- All property videos are delivered unbranded, with the exception of Video Business Cards and business promos. Property addresses are shown on screen at the start and end of each video.
- Final runtime will fall within the range described at checkout and is at the sole discretion of the editor, based on the content available at the property.
6.2 Revisions
- Re-edits are provided at no cost only for technical errors on the part of the videographer or editor, such as out-of-focus or bumpy shots, misspellings, and rendering glitches.
- All subjective choices - including but not limited to pacing, music selection, final runtime, fonts, color grade, shot length, transitions, and sound design - are at the sole discretion of the editor and are not eligible for free re-edits.
- Re-edits for subjective or artistic preferences are available at a rate of $150 per hour.
- Videos may not be re-edited (except to add Client branding as permitted in Section 3.2) or used for any purpose other than marketing the property shown.
6.3 FPV Flythrough
- Runtime varies based on property size and flight path; runtimes shown at checkout are estimates only and cannot be guaranteed.
- The flight path and the spaces showcased are at the sole discretion of the on-site pilot, for safety and practical reasons. A-Frame cannot guarantee that every space will be flown into.
- Wind or weather conditions may require multiple shots and edits rather than one continuous take, as may properties with multiple buildings.
- Reshoots are provided at no cost for technical failures such as out-of-focus footage, card failures, or sensor glitches. Reshoots are not available for subjective differences, including flight path, speed, music, color grade, or pacing.
- Delivered unbranded, in 4K resolution, with the property address at the beginning and end.
6.4 Video Business Cards and Business Promos
- The Client is solely responsible for: securing locations; securing any individuals appearing on screen as extras or giving testimonials; having location forms and talent releases (provided by A-Frame via email) printed and signed by the day of production; and completing their voiceover or script by the day of production.
- The Client may appear on camera or provide an audio voiceover. A template will be supplied by A-Frame. The Client may describe the desired tone at checkout, but all creative choices - including sound, music, color, pace, tone, and runtime - are at the sole discretion of A-Frame.
- Production time is limited to 3 hours, including drive time between locations (drive time before and after production is not counted). No more than 2 locations are recommended.
- Base templates do not include motion graphics, visual effects, CGI, or custom music.
6.5 Turnaround Times
- Drone flyover, walkthrough, flowscape, and FPV flythrough: 48 hours.
- Video Business Card and business promo: 5 business days.
7. Cancellation and Rescheduling
7.1 Photography Services
- Clients may cancel or reschedule up to 24 hours before the scheduled shoot time at no charge.
- Cancellations within 24 hours of the shoot incur a fee of 50% of the total project cost. The Client authorizes A-Frame to charge the card on file for this fee.
- Refunds are issued for the amount paid, less a credit card processing fee of 3% or $10, whichever is greater, and less any applicable late-cancellation fee.
- Weather-related cancellations (rain, wind, or snow) are exempt from cancellation fees. Overcast conditions do not qualify as weather-related.
- Rescheduling fee: $50 for in-town shoots; $50 plus the standard out-of-town fee for travel shoots.
7.2 Video Business Cards and Business Promos
- Cancellations with 48 or more hours' notice receive a full refund, less the credit card processing fee (3% or $10, whichever is greater).
- Cancellations within 48 hours of the shoot incur a kill fee of 50% of the total project cost.
- Rescheduling is encouraged and does not incur a fee.
8. Insurance and Limitation of Liability
- A-Frame photographers and videographers are independent subcontractors of A-Frame Photo & Aerial and are required to carry a $1,000,000 liability insurance policy. Any insurance claims must be resolved between the Client and the subcontracted photographer or videographer.
- A-Frame reserves the right to cancel any shoot for any reason at any time. If A-Frame cancels, the Client will receive a full refund.
- A-Frame is not liable for any Client-added content that infringes intellectual property rights.
9. Renewal and Transfer
- Marketing kit renewal is available for $25.
- A third party may purchase a transfer of license for 50% of the original order cost. All original terms apply to transferred licenses.
10. Digital Enhancement Notice and MLS Responsibility
- Delivered images may include digital enhancements, including but not limited to sky replacement, day-to-dusk conversion, and general retouching. These edits are aesthetic only and may not reflect actual on-site conditions.
- MLS guidelines commonly require agents to disclose digitally enhanced images. The Client acknowledges and agrees that all MLS compliance, disclosure requirements, and listing accuracy are solely the responsibility of the listing agent, and A-Frame assumes no liability for MLS violations or nondisclosure.
11. Acceptance
By purchasing, scheduling, or using A-Frame's Services, the Client agrees to all terms and conditions herein.
